Summary or Abstract : .در بیشتر موارد در هنگام ترجمه با زبان‌هایی سروکار داریم که از لحاظ زبان‌شناسی با هم تفاوت‌های اساسی دارند .آگاهی از این تفاوت‌ها جزء لاینفک کار ترجمه است و تعیین آن‌ها تنها از طریق مقایسه‌ی متون ترجمه شده امکان‌پذیر است .در این تحقیق ساخت اطلاع متون حقوقی بین‌المللی که از زبان انگلیسی به فارسی ترجمه شده‌اند مورد بررسی گرفته و تغییراتی که به لحاظ ساختار جمله در ترجمه حاصل شده مشخص شده است .هدف از آن آگاه کردن مترجمان از چنین تغییراتی است.یافته های تحقیق عبارتند از:۱- جملات نشاندار انگلیسی و ترجمه‌ی فارسی آنها۲-جملات مجهول نشاندار انگلیسی و ترجمه فارسی آنها۳-جملات برجسته شده‌ی انگلیسی و ترجمه فارسی آنها.نتایج این تحقیق نشان می دهد که در متون حقوقی بین‌المللی جملات مجهول پربسامدترین انواع جملات نشاندار هستند بنابراین یکی از وظایف مدرسان ترجمه آگاه کردن دانشجویان در این باره است.پیشنهاد می شود این تحقیق در مورد انواع دیگر متون با ژانرهای مختلف انجام شود .همچنین می‌توان متونی را که از فارسی به انگلیسی ترجمه شده‌اند مورد مطالعه قرار داد
: This research is a descriptive and analytical corpus-based study on Information Structure in English international legal documents and their Persian translations within the framework developed by Halliday (1985) to investigate foregrounding processes in building marked forms and their different types. The corpus of the research was a parallel one, comprising 200,000 words in three main texts along with their subtexts, including Universal Declaration of Human Rights, Geneva Conventions and Additional Protocols and The Convention of the Rights of the Child along with their translations into Persian. Out of the six types of marked forms, one (i.e. tonic stress) was ignored due to its exclusive use in oral/spoken discourse. The other five types were taken into consideration and the texts were examined to find examples of marked forms. Examining the texts randomly, the researcher found some 1771 sentences were found out of which 745 (42 ) were distinguished as marked forms. These sentences were classified according to the foregrounding processes within Halliday's Information Structure. Then a comparison was made with their Persian translation. The comparison revealed that 68 of the marked sentences were translated into marked forms, 28 were rendered unmarked and 4 were translated into a phrase rather than a sentence. While passivization proved to be the most frequent form in international legal texts (87 of the marked forms), a rather few number of topicalized forms (13 of the marked forms) were found, and no example of it-clefts, pseudo-clefts and scrambled forms were observed. The results show that it is important for translators to be aware of the fact that failure to take into consideration the Information Structure of the texts may lead to translations which will not communicate the semantic content of the original text. A further conclusion was that the frequent occurrence of the passive form in legal documents renders them unmarked forms, a point which has to be observed when translating such texts, and it is imperative that such consciousness should be given to translation trainees in the course of their studies..
