Summary or Abstract : Previous comparative fault tort reform research has concentrated on examination of the comparative fault doctrine from an entrepreneurial perspective, focused primarily on the costs of consumer safety weighed against costs of liability and economic efficiency, yet without specific theoretical development or analysis. The present study examined the development of comparative fault theory as it has been operative in sports and recreation cases in the United States. Additionally, this study examined how the shift in legal theory to comparative fault has influenced the ethical practices of recreation and sports practitioners at institutions..
